EUIPO and EU Member States' Intellectual Property Offices Common Communication on the common practice CP10: “Criteria for assessing disclosure of designs on the internet”
Today, 01/04/2020, the Intellectual Property Offices of the European Union and the European Union Intellectual Property Office (EUIPO) have been publishing simultaneously on their websites a Common Communication on the common practice in relation to CP10: “Criteria for assessing disclosure of designs on the internet”
The Common Communication and the Common Practice Principles attached thereto constitute a recommendation to the Intellectual Property Offices, Consumer Associations, Applicants and Representatives. The documents are publicly available and provide a clear and comprehensive explanation of the principles on which the common practice is based. These principles will serve as a guideline to ensure that different agencies come to a similar and predictable conclusion when considering the same grounds for refusal.
