Updates in the Common Communication on the representation of new types of trade marks
Today, 3rd April 2020, the Patent Office of Republic of Bulgaria provides users with updated information on
Common Communication on the representation of new types of trade marks.
It provides structured information  on the types of marks, their definitions and means of representation in respect of each intellectual property office of the Member states and EUIPO. The update shows the changes made by the IPOs of Hungary, France, Ireland, Poland and Latvia. The last update was in 2019.

EUIPO and EU Member States' Intellectual Property Offices Common Communication on the common practice CP9 : "Distinctiveness of three-dimensional marks (shape marks) containing verbal and/or figurative elements when the shape is not distinctive in itself":

Today, 01/04/2020, the Intellectual Property Offices of the European Union and the European Union Intellectual Property Office (EUIPO) have been publishing simultaneously on their websites a Common Communication on the common practice in relation to a draft Cohesion Program CP9: Distinctiveness of three-dimensional marks (shape marks) containing verbal and/or figurative elements when the shape is not distinctive in itself.

The Common Communication and the Common Practice Principles attached thereto constitute a recommendation to the Intellectual Property Offices, Consumer Associations, Applicants and Representatives. The documents are publicly available and provide a clear and comprehensive explanation of the principles on which the common practice is based. These principles will serve as a guideline to ensure that different agencies come to a similar and predictable conclusion when considering the same grounds for refusal.

Updates of the Common Communication on the representation of new types of trade marks

The Patent Office of the Republic of Bulgaria presents to the attention of all interested parties text of the General Notice on the Representation of New Types of Marks with the updates from the practices of of the national offices of Denmark, Spain and Portugal.
The national offices of Austria, the Czech Republic, Denmark, Estonia, France, Hungary, Italy, Portugal and Sweden have made changes to the accepted file formats for the new trademarks types.
The previous revisions of the text of the Common Communication and accepted file formats were published on December 3, 2018.
